 NOTICE UNDER REGULATION 21 OF THE
CLEAN WATERS REGULATIONS 1972

 

WHEREAS -

The Environment Protection Authority (the EPA) considers that stormwater runoff from urban areas adversely impacts on the quality of the environment in New South Wales and believes that the preparation and implementation of Stormwater Management Plans will provide for more effective management of urban stormwater, thereby contributing to environment protection.

 

TAKE NOTICE THAT -

In accordance with the powers vested in the EPA under Regulation 21 of the Clean Waters Regulations 1972, the EPA, by this Notice, hereby requires the ROADS AND TRAFFIC AUTHORITY (RTA) to:-

  1. Participate in the preparation of a Stormwater Management Plan (the Plan) with local councils for each of the catchments, districts or local government areas listed in the attached Schedule, within which the ROADS AND TRAFFIC AUTHORITY has responsibility for stormwater management of State Roads, in accordance with the following conditions:
    1. The Plans must be prepared in cooperation with other Stormwater Managers within each catchment, district or local government area;
    2. The Plan must be prepared in consultation with all relevant stakeholders, including the community, any relevant Catchment Management Committees or Trusts, the Environment Protection Authority and the Department of Land and Water Conservation;
    3. The Plan must take into consideration the findings and recommendations of any relevant catchment, estuary or floodplain management plan, or Healthy Rivers Commission report;
    4. The Plan must contain, but need not be limited to, the following:
      1. A brief description of the catchment, including climate, topography, water quality, streamflow, aquatic ecosystems and habitats, riparian vegetation, point sources of pollution, major sewer overflows and urban bushland areas;
      2. Clearly defined stormwater management objectives for both existing and proposed urban areas;
      3. Identification of stormwater management problems and issues;
      4. An evaluation of potential stormwater management practices (both non-structural and structural) to address the identified problems and issues;
      5. An Implementation Strategy, which includes prioritisation of specific management actions to be implemented by each stormwater manager in the catchment and a tentative timeframe for their implementation;
      6. A monitoring program to assess the effectiveness of the Plan, and identify any necessary refinements;
      7. A mechanism for reporting the effectiveness of the Plan to stakeholders, including the community; and
      8. A program for revising the Plan and linking its implementation to the RTA's budgetary planning process.
    5. The Plan must be submitted to the EPA by the date noted in the Schedule;
  1. Participate in the preparation of a Stormwater Management Plan (the Plan) with the National Parks and Wildlife Service for the urban areas in Kosciuszko National Park, within which the ROADS AND TRAFFIC AUTHORITY has responsibility for stormwater management of State Roads, in accordance with the conditions noted in section (1) of this Notice. The Plan is to be submitted to the EPA by 24 May 2000.
  2. Submit to the EPA a Stormwater Environment Improvement Program (the Program) comprising all actions identified in the Plans that the RTA is responsible for implementing. The Program is to be submitted in three parts according to the plan groups noted in the Schedule:

    1. Part 1 is to be completed by 24 May 1999 and is to contain all actions to be implemented by the RTA from the group 1 plans;
    2. Part 2 is to be completed by 24 May 2000 and is to contain all actions to be implemented by the RTA from the group 2 plans and the plan for urban areas in Kosciuszko National Park;
    3. Part 3 is to be completed by 24 May 2001 and is to contain all actions to be implemented by the RTA from the group 3 plans.
  3. Implement the actions identified in each Part of the Program.
  4. Notify the Director-General of the EPA of any substantial amendments to the Program.
  5. Submit to the EPA a Code-of-Practice for Stormwater Environment Management (the Code-of-Practice) by 24 April 1999. The Code-of-Practice is to be prepared in consultation with the EPA and is to specify policies and principles to be adopted by the RTA in the management of stormwater for environmental protection purposes from the construction, operation and upgrading of State Roads.
  6. Obtain the written consent of the Director-General of the EPA for any substantial amendments to the Code-of-Practice and notify the Director-General of any minor amendments.
  7. Adhere to the approved Code-of-Practice when planning, constructing, operating and upgrading State Roads.
  8. Obtain the prior written consent of the Director-General of the EPA for any variation from the Code-of-Practice for individual projects.

For the purposes of this notice:

 

  1. "State Roads" are a category of roads as defined in the RTA's publication "Arrangements with Councils for Road Management";
  2. "upgrading" is defined as works of a magnitude equal to or greater than the construction of an additional traffic lane;
  3. the definitions of "Catchment Management Committee" and "Catchment Management Trust" are to be taken as those in the Catchment Management Act 1989;
  4. the definition of "environment protection" is to be taken as that defined in the Protection of the Environment Administration Act 1991;
  5. "Stormwater Manager" includes local councils and State Government agencies or trading enterprises with a significant responsibility for stormwater or land management within the catchment;
  6. "Urban Area" is defined as any town or city with a resident population that exceeds 1,000 people.

Schedule of Catchments, Districts and Local Government Areas

Group 1: Plans to be completed by 24 April 1999

Berowra Creek catchment;

Berowra Creek catchment is defined as that area which drains to Berowra Creek and its tributaries, together with other catchments which drain northerly to the Hawkesbury River downstream of the Wisemans Ferry and upstream of the Peats Ferry Bridge

Blue Mountains district.

Blue Mountains district is defined as the entire Blue Mountains local government area, together with both that portion of the Penrith local government area located to the west of the Nepean River, and that portion of the Hawkesbury local government area located to the south and west of both the Bells Line of Road, the Old Bells Line of Road, Grose Vale Road and the Grose River Road.

Cattai Creek catchment.

Cattai Creek catchment is defined as that area which drains to Cattai Creek and its tributaries, together with other catchments which drain northerly to the Hawkesbury River at locations downstream of the confluence of South Creek and the Hawkesbury River, and upstream of the Wisemans Ferry.

Cooks River catchment

Cooks River catchment is defined as that area which drains to the Cooks River and its tributaries, including the Alexandra Canal and Wolli Creek;

Cowan Creek catchment

Cowan Creek catchment is defined as that area which drains to Cowan Creek and its tributaries, together with catchments which drain northerly into the Hawkesbury River between the Peats Ferry Bridge and West Head;

Duck River catchment.

Duck River catchment is defined as that area which drains to the Duck River and its tributaries, together with other catchments located to the south of the Parramatta River and which drain to the Parramatta River at points downstream of the Parramatta Weir and upstream of the mouth of Homebush Bay.

Eastern Suburbs Coastal catchment.

Eastern Suburbs Coastal catchment is defined as that area which drains directly to the Pacific Ocean at points located between South Head in the north and Cape Banks in the south.

Gosford District

Gosford District is defined as the entire Gosford local government area, excluding those portions which drain to Tuggerah Lake or any coastal catchments north of Yumbool Point.

Hacking River catchment;.

Hacking River catchment is defined as that area which drains to the Hacking River, Bate Bay and their tributaries;

Homebush Bay catchment;

Homebush Bay catchment is defined as that area which drains to Homebush Bay and its tributaries, including Powells Creek and Haslams Creek

Local government area

Lake Illawarra – Shellharbour catchment.

Lake Illawarra – Shellharbour catchment is defined as that area which drains to Lake Illawarra, together with the remainder of the Shellharbour local government area and that portion of the Wollongong area which drains to the Pacific Ocean at points located south of Red Point at Port Kembla;

Lake Macquarie catchment;

Lake Macquarie catchment is defined as the catchment of Lake Macquarie, together with all coastal catchments between (and including) Glenrock Lagoon in the north, and Desoto Inlet (at Catherine Hill Bay) in the south

Lane Cove River catchment.

Lane Cove River catchment is defined as that area which drains to the Lane Cove River and its tributaries.

Liverpool District

Liverpool District is defined as that area which drains to the Georges River at locations downstream of the Cambridge Avenue Causeway at Glenfield, and upstream of the confluence of the Georges River with Prospect Creek. This area includes the catchment of the Cabramatta Creek and its tributaries.

Lower Georges River catchment; and

Lower Georges River catchment is defined as that area which drains to the Georges River downstream of the mouths of Salt Pan Creek and the Woronora River on the north and south sides of the River respectively, together with those catchments which drain directly to Botany Bay at points located south of the mouth of the Cooks River, and west of Point Long Nose on the Kurnell Peninsula;

Lower Parramatta River catchment;

Lower Parramatta River catchment is defined as that area which drains to the Parramatta River at points downstream of the Ryde Bridge and upstream of a line joining Clarkes Point at Woolwich and Robinson Point at Birchgrove.

Maitland District

Maitland District is defined as including the entire Maitland local government area, together with that portion of the Newcastle local government area which drains to either Purgatory Creek or Greenways Creek.

Mid Georges River catchment;

Mid Georges River catchment is defined as all catchments which drain to the Georges River at locations downstream of the confluence of the Georges River and Prospect Creek, and upstream of the confluence of Mill Creek with the Georges River.

Mid Nepean-Hawkesbury River catchment;

Mid Nepean-Hawkesbury River catchment is defined as that portion of the Penrith local government area located east of the Hawkesbury – Nepean River, excluding the South Creek and Upper Nepean catchments, together with that portion of the Hawkesbury local government area which drains to the Hawkesbury Nepean River upstream of the confluence of the Colo River with the Hawkesbury-Nepean River, excluding the South Creek and Cattai Creek catchments and the Blue Mountains District;

Mid Parramatta River catchment;

Mid Parramatta River catchment is defined as that area lying to the north of the Parramatta River and which drains in a southerly direction to the Parramatta River at points located downstream of the Parramatta Weir and upstream of the Ryde Bridge;

Middle Harbour catchment;

Middle Harbour catchment is defined as that area which drains to Middle Harbour and its tributaries. The mouth of the Harbour is defined by Grotto Point at Clontarf and Middle Head;

Mill Pond Creek catchment.

Mill Pond Creek catchment is defined as that area which drains into Botany Bay at points located between Cape Banks and the mouth of the Cooks River.

Newcastle District.

Newcastle District is defined as those portions of the Newcastle and Lake Macquarie local government areas which lie within the catchments of that reach of the Hunter River which extends from the Hexham bridge to the mouth of the River, together with the catchment of the Hexham Swamp and any coastal catchments between (but not including) Glenrock Lagoon in the south, and that length of Stockton Beach which lies within the Newcastle local government area..

Northern Beaches catchment.

Northern Beaches catchment is defined as all catchments which flow to the sea, or to Port Jackson, at points located between Turimetta Head in the north and Grotto Point in Port Jackson.

Pittwater catchment;

Pittwater catchment is defined as the catchment of Pittwater, together with all coastal catchments between Barrenjoey Head in the north and Turimetta Head in the south;.

Port Jackson North catchment.

Port Jackson North catchment is defined as those areas located on the north side of Port Jackson which drain to Port Jackson at points located between the mouth of the Lane Cove River and Middle Head.

Port Jackson South catchment.

Port Jackson South catchment is defined as those areas located on the south side of Port Jackson which drain to Port Jackson at points located between Robinson Point at Birchgrove and South Head.

Port Stephens

Local government area

Prospect Creek catchment.

Prospect Creek catchment is defined as that area which drains to Prospect Creek and its tributaries, including Orphan School Creek.

Salt Pan Creek catchment;

Salt Pan Creek catchment is defined as that area which drains to Salt Pan Creek and its tributaries;

South Creek catchment.

South Creek catchment is defined as that area which drains to South Creek and its tributaries, including Eastern Creek and Ropes Creek.

Tuggerah Lakes catchment.

Tuggerah Lakes catchment is defined as the catchment of the Tuggerah Lake (including that of Lake Munmorah), together with coastal catchments between Desoto Inlet (at Catherine Hill Bay) in the north, and Yumbool Point in the south.

Upper Georges River catchment

Upper Georges River catchment is defined as that area draining to the Georges River at points upstream of the Cambridge Avenue Causeway at Glenfield.

Upper Nepean River catchment

Upper Nepean River catchment is defined as that area which drains to the Nepean River upstream of the confluence of the Warragamba River and the Nepean River

Upper Parramatta River catchment

Upper Parramatta River catchment is defined as that area which drains to the Parramatta River upstream of the Parramatta Weir

Wollondilly District.

Wollondilly District is defined as the entire Wollondilly local government area excluding those portions within either the Upper Nepean River catchment or the Upper Georges River catchment.

Wollongong Coastal catchment;

Wollongong Coastal catchment is defined as that portion of the Wollongong local government area which drains directly to the Pacific Ocean at points located north of Red Point at Port Kembla, and south of Stanwell Park beach;

Woronora River catchment;

Woronora River catchment is defined as that area which drains to either the Woronora River or Mill Creek;
