DIRECTION UNDER SECTION 12 OF THE
PROTECTION OF THE ENVIRONMENT ADMINISTRATION ACT 1991

WHEREAS –

  1. The Environment Protection Authority (the EPA) considers that stormwater runoff from urban areas adversely impacts on the quality of the environment in New South Wales and believes that the preparation and implementation of Stormwater Management Plans will provide for more effective management of urban stormwater, thereby contributing to environment protection.
  2. The EPA has previously issued a Direction under the Section 12 of the Protection of the Environment Administration Act, 1991 (the Direction) requiring the «ORGNAME» to prepare Stormwater Management Plans for specific catchments, districts or local government areas;
  3. A number of local councils have expressed concern in relation to completing the Stormwater Management Plans for submission to the EPA within the 12 months time period required by the EPA.

TAKE NOTICE THAT -

In accordance with the powers vested in the EPA under Section 12 of the Protection of the Environment Administration Act, 1991 the EPA, by this Notice, hereby: -

  1. Repeals the previous Direction, dated 24 April 1998, issued to the «ORGNAME» under Section 12 of the Protection of the Environment Administration Act, 1991 requiring «ORGNAME» to prepare a Stormwater Management Plan for urban areas within specified catchments, districts or local government areas;
  2. Directs «ORGNAME» to prepare Stormwater Management Plans (the Plans) for urban areas within the:
  1. «CATCHMENT AREAS»

Each Plan must be prepared in accordance with the following conditions:

2.1 The Plan must be prepared in cooperation with other Stormwater Managers within the catchment;

2.2 The plan must be prepared in consultation with all relevant stakeholders, including the community, any relevant Catchment Management Committees or Trusts, the Environment Protection Authority and the Department of Land and Water Conservation;

2.3 The Plan must take into consideration the findings and recommendations of any relevant catchment, estuary or floodplain management plan, or Healthy Rivers Commission report;

2.4 The Plan must contain, but not need to be limited to, the following:

  1. A brief description of the catchment, including climate, topography, water quality, streamflow, aquatic ecosystems and habitats, riparian vegetation, point sources of pollution, major sewer overflows and urban bushland areas;
  2. Clearly defined stormwater management objectives for both existing and proposed urban areas;
  3. Identification of stormwater management problems and issues;
  4. An evaluation of potential stormwater management practices (both non-structural and structural) to address the identified problems and issues ;
  5. An Implementation Strategy, which includes prioritisation of specific management actions to be implemented by each stormwater manager in the catchment and a tentative timeframe for their implementation;
  6. A monitoring program to assess the effectiveness of the Plan, and identify any necessary refinements;
  7. A mechanism for reporting the effectiveness of the Plan to stakeholders, including the community; and
  8. A program for revising the Plan and linking its implementation and future review to the process of Council state of the environment reporting and council management planning prescribed in the Local Government Act 1993 and related regulations.

2.5 The Plan must be submitted to the EPA by no later than 24 July 1999;

2.6 For the purposes of this direction:

  1. the definitions of "Catchment Management Committee" and "Catchment Management Trust" are to be taken as those in the Catchment Management Act 1989;
  2. "Stormwater Manager" includes local councils and State Government agencies or trading enterprises with a significant responsibility for stormwater or land management within the catchment;
  3. "Urban Area" is defined as any town or city with a resident population that exceeds 1,000 people;

Berowra Creek catchment is defined as that area which drains to Berowra Creek and its tributaries, together with other catchments which drain northerly to the Hawkesbury River downstream of the Wisemans Ferry and upstream of the Peats Ferry Bridge

Blue Mountains district is defined as the entire Blue Mountains local government area, together with both that portion of the Penrith local government area located to the west of the Nepean River, and that portion of the Hawkesbury local government area located to the south and west of both the Bells Line of Road, the Old Bells Line of Road, Grose Vale Road and the Grose River Road.

Cattai Creek catchment is defined as that area which drains to Cattai Creek and its tributaries, together with other catchments which drain northerly to the Hawkesbury River at locations downstream of the confluence of South Creek and the Hawkesbury River, and upstream of the Wisemans Ferry.

Duck River catchment is defined as that area which drains to the Duck River and its tributaries, together with other catchments located to the south of the Parramatta River and which drain to the Parramatta River at points downstream of the Parramatta Weir and upstream of the mouth of Homebush Bay.

Eastern Suburbs Coastal catchment is defined as that area which drains directly to the Pacific Ocean at points located between South Head in the north and Cape Banks in the south.

Lower Georges River catchment is defined as that area which drains to the Georges River downstream of the mouths of Salt Pan Creek and the Woronora River on the north and south sides of the River respectively, together with those catchments which drain directly to Botany Bay at points located south of the mouth of the Cooks River, and west of Point Long Nose on the Kurnell Peninsula;

Mid Georges River catchment is defined as all catchments which drain to the Georges River at locations downstream of the confluence of the Georges River and Prospect Creek, and upstream of the confluence of Mill Creek with the Georges River.

Mid Nepean-Hawkesbury River catchment is defined as that portion of the Penrith local government area located east of the Hawkesbury – Nepean River, excluding the South Creek and Upper Nepean catchments, together with that portion of the Hawkesbury local government area which drains to the Hawkesbury Nepean River upstream of the confluence of the Colo River with the Hawkesbury-Nepean River, excluding the South Creek and Cattai Creek catchments and the Blue Mountains District;

Newcastle District is defined as those portions of the Newcastle and Lake Macquarie local government areas which lie within the catchments of that reach of the Hunter River which extends from the Hexham bridge to the mouth of the River, together with the catchment of the Hexham Swamp and any coastal catchments between (but not including) Glenrock Lagoon in the south, and that length of Stockton Beach which lies within the Newcastle local government area..

Northern Beaches catchment is defined as all catchments which flow to the sea, or to Port Jackson, at points located between Turimetta Head in the north and Grotto Point in Port Jackson.
