Notice to amend ongoing management order

(Section 44 of the Contaminated Land Management Act 1997)

Background

The land to which this notice applies was declared as “significantly contaminated land” (declaration no.20101109) and is the subject of a management order (order no.20131402) issued by the Environment Protection Authority (“the EPA”). The management order directs the recipient of the order to carry out contamination management to ensure the required environmental and human health outcomes and timeframes for the remediation of contamination from the site are achieved. This management includes, amongst other things, implementation of the Remediation Action Plan (RAP) (ref. Report for United Service Station, Sutherland, Remedial Action Plan – Phase 1, GHD Report no.21/212118/176761 July 2012), which details measures to prevent further migration of contaminated groundwater offsite and remove to the extent practicable the light non-aqueous phase liquid (LNAPL).

The EPA has taken into consideration the request made by the recipient of the order when granting the above amendments to the milestones. In addition to the above amended milestones, the EPA makes the following amendments to the order:

·         1A. Capital Works (ii) “Pump out of MH8 and other points as appropriate” to include: “following the unblocking of MH8, monitoring of discharge to be undertaken every 3 months for the first year, if these results are acceptable to Council, monitoring to continue on an annual basis until completion of the remedial works. If the results at any stage indicate the drainage water is no longer suitable for discharge to stormwater Council will require MH8 to be re-plugged and the routine pump out to be re-established.

·         In addition to the above, following the advice from Council regarding the discharge water from the manhole to the east of the steel reservoir, once Sydney Water has completed the blocking of this manhole, the following is required: “Monitoring and pump out of the manhole to the east of the steel reservoir. Specific requirements to be agreed with Council.”

·         2. Delineation of groundwater plume to the east and north east. Following the identification of high concentrations of contamination in the offsite wells to the east of the service station, further delineation is required to determine the extent of this offsite plume, identify potential preferential pathways (e.g. along underground services) and to identify suitable measures to manage/mitigate any risks to offsite receptors. To be completed by 29 April 2014.

Other than the amendments set out in this notice, the remaining terms of the management order (order no. 20131402), remain in force.

Information recorded by councils

Section 59 of the Act requires the EPA to give a copy of this notice to the relevant local council.  The council may then make appropriate consequential modifications to the planning certificate issued in relation to the land to which this notice applies pursuant to s.149 of the Environmental Planning and Assessment Act 1979

Relationship to other regulatory instrument

This repeal notice does not affect the provisions of any relevant environmental planning instruments which apply to the land or provisions of any other environmental protection legislation administered by the EPA.

 

Previous regulatory instrument

As of 1 July 2009, all current declarations for investigation area or declarations for remediation sites are taken to be declarations for significantly contaminated land, all current orders for investigation area and orders for remediation site are taken to be management orders and all current voluntary investigation and remediation agreements are taken to be voluntary management proposals.
