Biodiversity Offsets Scheme brokers

 

The Biodiversity Conservation Act 2016 allows for brokers to provide Biodiversity Offsets Scheme services.

The provisions for brokers are not prescribed in the Biodiversity Conservation Regulation 2017.

The department is not currently accrediting brokers.

Broker services

Broker services may include:

  • identifying potential biodiversity stewardship sites or management actions
  • negotiating a biodiversity agreement on behalf of a landholder
  • assistance with buying or selling biodiversity credits.

Broker responsibilities

Anyone conducting a brokering service should consider whether they are providers of financial services under the provisions of the Corporations Act 2001 (Cth) and the Australian Securities and Investments Commission Act 2001 (Cth) and should be aware of the laws, any licences or permits and industry codes of conduct that may apply to the financial and insurance services industry and to any specific service they provide.
