Reason for the draft regulation
The NSW Government is developing amendments to the Biodiversity Conservation Regulation 2017 to improve the Biodiversity Offsets Scheme, in line with commitments in the NSW plan for nature.
As part of this, the department is seeking feedback on the draft Biodiversity Conservation Amendment (Biodiversity Offsets Scheme) Regulation 2026 (the draft regulation).
The department has also released a consultation paper to help explain the proposed amendments, why government is proposing them and to seek your feedback on elements of the draft regulation.
The draft regulation includes measures to:
- strengthen avoidance and minimisation of impacts to biodiversity values
- reduce reliance on the Biodiversity Conservation Fund
- better balance the application of the scheme with the biodiversity risks for small, low-impact projects
- improve oversight of conservation brokers
- make credit transaction fees fairer and more efficient.

- help test whether the amendments are clear, practical, and workable for those who use the scheme
- inform refinements so that amendments deliver positive outcomes for scheme stakeholders and biodiversity values.
