Under Section 7.7(3) of the Biodiversity Conservation Act 2016, the Environment Minister may, by Ministerial order, exempt a local development application from the requirement to be accompanied by a biodiversity development assessment report on either of the following grounds–
- to expedite the application in response to, or in connection with, a natural disaster
- if, in the Minister's opinion, there are exceptional circumstances that make it appropriate to exempt the application from the requirement.
Section 9.7 of the Biodiversity Conservation Act 2016 requires that a public register be kept tracking these Ministerial exemption orders.
