A determination for provisional listing on an emergency basis can only be made if the species either:
- is believed, on current knowledge, to be native to New South Wales, even though it was not previously known to have existed in New South Wales
- is subject to an immediate and significant threat of extinction
- was presumed to be extinct or extinct in the wild but has been rediscovered.
The Scientific Committee's ability to list critically endangered and endangered species on an emergency basis is set out in Division 4 of the Biodiversity Conservation Act 2016.
After the provisional listing of a critically endangered or endangered species, the Scientific Committee must place a preliminary determination on display for public consultation and must make a final determination about the species within 2 years of the provisional listing.
Provisional determinations of critically endangered and endangered species on an emergency basis will be listed here when announced and are removed from this page when a final determination has been made.
