NSW Coastal Panel

The NSW Coastal Panel is a statutory authority under Part 2A of the Coastal Protection Act 1979, with membership comprising local government and public authority nominees.

The membership of the panel is:

  • Emeritus Professor Bruce Thom - Chair
  • Professor Andrew Short - nominee of Local Government NSW
  • Ms Jane Lofthouse - nominee of Local Government NSW
  • Associate Professor Ron Cox - nominee of Local Government NSW
  • Mr Derek Rutherford - Office of Environment and Heritage nominee and Deputy Chair
  • Mr Stephen Murray - Department of Planning and Environment nominee
  • Mr Stephen Wills - Department of Industry (Lands) nominee

The panel's role is to provide expert advice to the Minister administering the Act and to local councils. The Minister may also refer draft coastal zone management plans to the panel for review.

Under Division 25 of Part 3 of the Infrastructure State Environmental Planning Policy (SEPP), the Coastal Panel has statutory roles in relation to coastal protection works on the open coast or at the entrance to estuaries. In addition, public authorities proposing new works must notify the panel before carrying out these works and take the panel's response into consideration. This role does not apply where the proposed works are in an area subject to a coastal zone management plan or in relation to emergency coastal protection works.

Development applications for coastal protection works where the Coastal Panel is the consent authority are to be lodged at the above address on this form (DOC 186KB).

The Coastal Panel has adopted the Department of Planning and Environment's Political Donations Disclosure Statement for the development applications it receives. This form is to be submitted with the development application to the above address.

Development application fees are set in clause 246 of the Environmental Planning and Assessment Regulation 2000.

Details of development applications received by the Coastal Panel will be made available on this website.

Submissions

The NSW Coastal Panel will advertise all development applications received, notify nearby landholders and relevant public authorities, and invite submissions.

Submissions must be received by the panel by close of business on the final day of the exhibition period and should include:

  • your name and address
  • the name of the application and the application number
  • a statement on whether you support or object to the project.

Submissions should be:

  • emailed to coastal.panel@environment.nsw.gov.au, or
  • faxed to (02) 9995 5939, or
  • posted to Chair, NSW Coastal Panel, c/- Office of Environment and Heritage, PO Box A290, Sydney South NSW 1232.

Everyone lodging a submission is required to declare all political donations (including donations of $1000 or more) made in the previous two years. Visit the Department of Planning and Environment for more details, including a disclosure form.

Public authority notifications for proposed coastal protection works

Notifications to the Coastal Panel under clause 129(2A) of the Infrastructure SEPP must be made in writing and provide sufficient information on the proposed coastal protection works, their potential impacts and the proposed mitigation actions to enable the panel to assess the proposed works. For example, a copy of a review of environmental factors or an environmental impact statement prepared under Part 5 of the Environmental Planning and Assessment Act 1979 should be provided to the panel.

The Coastal Panel will assess the proposed works, taking into consideration the objects of the Coastal Protection Act 1979 and provide recommendations to the public authority for consideration. OEH staff will review the implementation of these recommendations.

Advice on Kingscliff

The Minister for the Environment requested advice from the NSW Coastal Panel with respect to the management of beach erosion at Kingscliff in the Tweed Shire Council local government area.

The terms of reference for this advice were:

1. The Coastal Panel's opinion on the causes of the recent erosion at Kingscliff, including if this erosion is likely to continue and, if so, under what circumstances

2. Recommendations on potential short- and long-term technically feasible and cost-effective strategies for managing erosion at Kingscliff. This is to include a review of the strategies in the 2005 Tweed Shire Coastline Management Plan and any other strategies proposed by council.
