The Department of Planning, Industry and Environment – Environment, Energy and Science (the former Office of Environment and Heritage) is not the only body that may institute criminal proceedings under environment protection legislation. Organisations such as the NSW Environment Protection Authority may also bring proceedings under legislation they administer.

These guidelines are consistent with the EPA Prosecution Guidelines.
