Minimum standards of maintenance and repair
Major amendments to the Heritage Act 1977 passed both houses of State Parliament and came into effect on 2 April 1999. The changes are the result of substantial review of the NSW heritage system. One of the changes in policy reflected in the new legislation is the establishment
of Minimum Standards.

Since the original Heritage Act was passed in 1977 the
“wilful neglect” provisions had been ineffective in preventing the deterioration of
heritage items. In the twenty years of its operation there were no successful
prosecutions under this section of the Act.
The section has therefore been deleted and replaced. Owners of items listed on
the State Heritage Register are now required to ensure that heritage
significance is maintained. Owners are required to achieve minimum standards
of maintenance and repair.
